Pataki Finally Gets a Job

Former Governor and current sexiest man alive George Pataki was drafted in the 11th round by the Bush administration yesterday. He's expected to be a  third string back up to UN Ambassador Zalmay Khalilzad in the upcoming season. Barring serious injury to beloved veteran "Zee-Kay", the 62 year old from Peekskill isn't expected to start anytime soon, nor is he seen as the team's Ambassador of the future, though he may get some minutes during trash time and plenty of time with the practice squad.

Former Gov. George Pataki, who nosed around running for President and angled for a cabinet post that never came, finally got a job with the Bush administration yesterday.

The White House named Pataki and a couple of other retired pols with time on their hands to ceremonial posts as representatives to the 62nd session of the United Nations General Assembly, which convenes later this month. Pataki's main task will be to sit behind the sign saying "United States" and listen to speeches when U.S. Ambassador Zalmay Khalilzad can't be bothered.

Pataki isn't even the only person serving in this post.  Bush also named Reps. William Delahunt (D-MA) and Ted Poe (R-TX) to be Representatives of the United States to the 62nd Session of the United Nations General Assembly, as well as Alternates Kelly G. Knight, of Kentucky and Rodger D. Young, of Michigan (both are GOP fundraisers).

I'm not a constitutional scholar, but I have to wonder whether Poe and Delahunt would be eligible to serve as a presidential appointment/nomination.  Article I, Sec. 6 says that "no Person holding any Office under the United States, shall be a Member of either House during his Continuance in Office."  One annotation to this clause notes:

This . . . clause elicited little discussion at the Convention and was universally understood to be a safeguard against executive influence on Members of Congress and the prevention of the corruption of the separation of powers. Congress has at various times confronted the issue in regard to seating or expelling persons who have or obtain office in another branch.
Based on Rep. Delahunt's press release on the appointment, however, the nomination is portrayed as coming from Speaker Pelosi and the Democratic leadership, and the postion is seen as
The U.S. Congressional Delegation to the UN is a two member; bipartisan delegation that also includes Congressman Ted Poe from Texas.  Membership rotates between the Senate and the House.  The General Assembly's session opens in late September and runs until next April.
If that's the case, then it wouldn't be a position within the Executive Branch and it's all copacetic.

This would also seem to imply that the position is almost entirely ceremonial in function, which makes the Pataki nomination even more humorous and pathetic.

So, I did not notice anything much regarding smoking at the State Fair this year, but, wow, it was really a different and better experience not seeing pictures of Pataki all over the place.  It was as if the Dear Leader, Chairman Mao, or Lenin had "left the building," just like Elvis... invigorating, a breath of fresh air.  Small thing, but the Spitzer team did seem to get that one right.
