Could The "Gang Of Three" Deal Fall Apart?

by: robert.harding

Sat Dec 06, 2008 at 00:06:38 AM EST

If you thought soap operas only aired during the weekdays, just wait until tomorrow when the Senate Democrats meet in New York City.

According to Liz, that big deal made with the "Gang of Three" might come to a screeching halt tomorrow if some Democratic senators have their way.

I have spoken to several Democratic lawmakers now who employed words like "blowup" and "disgrace" to describe what might happen at the closed-door conference (the former characterization and the deal Smith struck with the Gang of Three (the latter), which senators who stuck by Smith and helped him fight for the majority consider giving away the store to the renegade threesome - two of whom have longstanding GOP ties.

There are a number of problems here, not the least of which is the fact that if the now-tenuous deal blows up, it will send the Senate Democrats back to the drawing board, return the chamber to leadership-free limbo and perhaps drive the trio back into the arms of the Republicans, at least in the short term.

Some Democrats say even staying in the minority for another session is preferable to giving away the store in a deal that empowers the Gang of Three. A few took particular offense at the idea that control of legislation would rest in the hands of Senator-elect Pedro Espada Jr. as vice chairman of the Rules Committee.

The reasoning behind this is that sooner or later, given the aged GOP conference and the demographics of the state, more seats are going to end up being won by Democrats. The year that everyone should really be concerned about is 2010, because that's when the Senate that will control the next round of redistricting will be elected.

I am going to propose this: If these three won't vote for a Democratic leader without deals, then let them vote for Dean Skelos. Then those three can go back to their Democratic districts in 2010 and explain to them why they voted for Dean Skelos over Malcolm Smith. That should be the bargaining chip here. There is no reason to cave to these three opportunists. Let them walk and explain to their voters in 2010 why they voted for a Republican state senate when their voters sent them to Albany to be part of a Democratic senate.

Yes, I am saying I would rather be in the minority for the next two years than to cave to the thugs who want to rob us and create their own "Gang of Three Men In A Room." Then we could have a real shot at getting three TRUE Democrats to replace the traitors and then build our majority throughout the state, including upstate where we made serious gains this year and on Long Island where there might be another seat or two to grab in 2010.

If Malcolm Smith wants to be a leader, he needs to show some fortitude. This deal is not only bad for Senate Democrats, but it is also bad for him. He needs to realize that and for the good of the caucus, I hope he will realize that before tomorrow's meeting.

You are correct (4.00 / 1)
Look, if these guys are this pro-republican about the majority fight, imagine what they will be like when it comes to redistricting.

Everyone knows that if the Democrats get our way in 2012 we're gonna draw ourselves at least 8 seats upstate, up from our current 4 (Aubertine's seat is not a Democratic one, its a Republican one held by a Democrat), and 2-3 on long island, up from 0 (see above, replace Aubertine with Johnson).

That moves the balance of power away from the gang of three - will these aholes be willing to give up that much control? Because with 4-5 extra Dems, they no longer hold the balance of power.

If Democrats get our way... (4.00 / 1)
Hopefully we implement an independent redistricting commission. Let's face it: In the future the Republicans could gain control of the Senate again and draw it up. Republicans are ruthless. They don't want reforms and fairness. They want things to go their way. Implementing an independent commission would eliminate the politicization of the process.

For the Senate and Assembly (0.00 / 0)
I'm down.

[ Parent ]
I agree it should be independent (4.00 / 1)
Another politically-motivated gerrymander will mean we've really accomplished almost nothing.  Same as it ever was.

I've got to think that an independent redistrict will net Democrats seats upstate and on the island, anyway.  Districts in the Senate are currently drawn to maximize Republican seats.  Any change will likely lead to more Democratic seats in the Senate.

[ Parent ]
Regardless of who does the districting (4.00 / 3)
Because of population shifts, there will probably be 3-4 more senators in 2012, and they'll all be from NYC.  In addition, 1-2 seats will shift from upstate into the city.

Come 2012, between Republican retirements and redistricting, Democrats will have firm control of the state Senate.  If the "Gang of Three" tries anything more than they've gotten, they're going to learn then that payback's a b****.

[ Parent ]
Amen (4.00 / 3)
Smith should have them out all their cards on the table.  He should dare them to vote for Skelos and see what happens at at the ballot box.  He should have Olga Mendez come and give the intro speech.

Let them have their day (0.00 / 0)
Let the "gang" have their day today and when the Democratic majority is stronger we can set things right. We have to deny the Republicans the majority and their access to money, otherwise they will turn on the tap against our new people.
"A patient man shall bear for a time and thereafter joy shall spring up unto him"
We must do what we have to do now and remember what they did when we are in a better position to deal with them.

I don't know... (4.00 / 1)
If letting them have their day is good for the New York State Senate. Most importantly, I don't think it's good for reform. Part of this deal would be to put a marriage equality bill on hold for at least two years. That is unacceptable. The "Gang of Three" is a group that is far from progressive. That means any progressive agenda would go out the window. I don't think anyone wants that.

[ Parent ]
What did you really expect (0.00 / 0)
Senate has long been a plum patronage post to send Brooklyn, Queens and Bronx Dems who were good party people, not necessarily good leaders. After all stuck in deep minority, what harm could they do.

All of sudden we're in charge with a gang of well meaning, but not all that inspiring party hacks comprising the caucus majority.

Reality check, other than Johnson, Schneiderman, Liz Krueger, Neil Breslin and Stachowski, this is a pack of serious lightweights. None of the aforementioned have a real chance of getting any serious consideration.

I mean really, Ruth Hassell-Thompson? Toby Stavisky? Suzi Oppenheimer (is she even still alive?)

Interesting thought, that (4.00 / 2)
I can remember hearing Smith's speech at the victory party for Darrel Aubertine.  It was an atmosphere of great expectations, and Smith called all the Democratic Senators to the stage.  He said that, come fall and winter, we were about to see all this "intellect" that had gone unappreciated and unexpressed take form and bring about great new things. (I'm paraphrasing).  Can remember at the time having a "we'll see" thought about exactly how much real intellectual power was amassed on the stage.  Had just met a staffperson from Liz Krueger's office who I really did think was very bright and principled, and was thinking about how much she was looking forward to having the physical and staff resources to do more real work (and leave more constituent services to others on-staff).

So, what did I really expect?  That it might not be easy or simple, that there would be some sorting out to be done.  That the voice of upstate Dems would have a hard time being heard, asserted.  That Senators would come into this with very different expectations about what would happen, and how.

Malcolm Smith, if you or your staff are reading this, lemmee tell ya something.  Real intellectual power is never ever silent, can't be silenced.  You can't beat it out of Frederick Douglas on Misery Mountain.  You can't chase it out of Sojourner Truth through the swamps.  You can't arrest or jail it out of Susan B. Anthony.  Failure is impossible, as we will just keep speaking truth to power, no matter the personal cost.  Our principles will prevail.

Look up at the North Star, and tell me that you can strike a deal to disenfranchise and silence the people of upstate NY.  We have some spirits watching you, and inspiring us:

We're all watching you, Malcolm.  What kind of NY leader are you, huh?

What's NOT interesting is that you named three women (0.00 / 0)
All of whom I would prefer to the likes of Farley, Morahan, or Padavan.

[ Parent ]
Not intentional (4.00 / 1)
And, I did name Liz Kruger as one of the good ones.  Since Smith, Espada, Carl Kruger and Diaz are already junk whom should I add?

As to your point of any Dem over any Rep. I fundamentally disagree. Good, progressive Dems who offer leadership is what is necessary. Hacks (over any gender, race or creed) hurt what we claim to support.

[ Parent ]
Malcolm needs to go (0.00 / 0)
The guy sold out his conference, and most of the conference has sold out principle in return for power. It is pathetic to watch the hacks continue to reap the rewards.

not so sure (4.00 / 1)
Smith's been a good leader and one who is actually committed to reform, by all accounts.  He may have botched this, but it's no firing offense.

[ Parent ]
He's no leader (0.00 / 0)
He's a front for Floyd Flake and a bunch of hedge fund managers.

[ Parent ]
Floyd Flake? (0.00 / 0)
Hm.  Would sure be interested in you sharing what you might know about that in a diary.  Hedge-fund dudes, too. Klein, too.

[ Parent ]
Retirements? (4.00 / 1)
This is a bad deal.  The one upside I see to it is that, if what I read elsewhere is correct, Senate pensions are based on the last year of service. Becoming minority members and losing their lulus could drive lots of Republicans into retirement.

Does anyone know if that info about the pensions is correct?  If so, I'd like to start a pool on who will fold up their tent first.  I bet on Dale Volker.

Senator Bill Struckoutski (4.00 / 1)
In Western New York it is viewed
That the deal left them royally screwed.
Stachowski and comrades, it's said,
Ought to jump into Skelos's bed.
Such a classical Democrat feat:
From victory's jaws snatch defeat.

Let the G of 3 go! (4.00 / 3)
I totally agree.  It will be MUCH easier to run a campaign to oust these guys if they are Republicans in Democratic districts during the next general election than as Democrats in the next primary election.
We will be far better off letting them bolt the Democratic party for two years now, and then have them be completely powerless (either as part of Republican minority, or voted out of power completely) starting in 2010.
These guys are carving out a VERY short term future for themselves, and I think that is a good thing.  Let them have it if they want!!

Ill say it again (0.00 / 0)
Maybe a bit louder and more concise this time, there are assholes on both sides of the isle that need to GTFO!!

Also (0.00 / 0)
I would just like to add, this infighting with the democrats its hilarious, and shows the people what type of leadership they are going to deal with, people that dont even respect their own party.

[ Parent ]
You know what (0.00 / 0)
you're right. Malcolm Smith has proved to me exactly who he is.

[ Parent ]
While I'm happy (0.00 / 0)
that there will be a Democratic Senate majority, I'm not happy about how it came about.

The Gang of Three blackmailers were rewarded, at the expense of the vast majority of Democratic senators who did not threaten to support Mean Dean.

The Democrats should pick up another couple three Senate seats in 2010, and hopefully they will then make committee and leadership assignments based on merit and seniority, and not on blackmail.

FAIL (0.00 / 0)
Malcolm gave leadership positions to two "Democrats," one who caucused with the Republicans, and one who consorted with the Republicans.

Smith sold out, and it will not stand.  Kruger will not be the Finance Chair.

[ Parent ]
Great. (0.00 / 0)
Just great.

This is who we get as Majority Leader?  http://www.nytimes.com/2008/12...

Jeff Klein (0.00 / 0)
So what's everybody know about our new leader this fellow?

Klein (0.00 / 0)
A complete hack.
