Sen. Adams Taking Monserrate's Side; More On Monserrate Incident

I should preface this post by saying that it isn't new that Sen. Eric Adams has said something outlandish during the month of December. Last year, Sen. Adams was yelling "show me the money" on the Senate floor. This year, he is coming to the defense of Senator-elect Hiram Monserrate, who has been accused of attacking his girlfriend.

To be fair, Sen. Adams doesn't defend what Monserrate allegedly did. But Sen. Adams does say that what happened with Monserrate is revenge from the New York City Police Department for Monserrate's fight for police reform.

Liz has the statement from Adams, which is a very interesting read.

"As a former NYPD Captain, I have some serious concerns regarding the unusual handling of the case against Councilman Monserrate," Adams said. "The primary goal of investigating a complaint of domestic violence is to ensure the safety of the innocent victim."

"However, the police department and the DA appear to have ignored Ms. Giraldo's repeated insistence that the injury she sustained was the result of an accident, a fact that has been publicly supported by Ms. Giraldo's family in interviews with the press."

"Second, the department departed from standard operating procedures by requiring a public 'perp walk' past TV cameras, rather than following the normal routine of taking someone out the back door through the precinct's private lot. A 'perp walk' is used when the the NYPD wants to expose a suspect to public view."

"These questions raise serious doubts regarding the motivating factor behind the arrest and charges against Councilman Monserrate. Specifically, these facts suggest that the Police Department's priority is to publicly humiliate the accused rather than following the evidence."

"It is well known that Councilman Monserrate has been an outspoken advocate for police reform. I believe his role as an agent for change cause him to be denied his rights and a thorough investigation."

We also have more information on the incident today. According to multiple media reports, Monserrate and his girlfriend were arguing about a business card found in the girlfriend's purse. The business card was reportedly from a Police Benevolent Association (PBA) member. Why that was enough to spark the alleged attack remains to be seen.

But why Sen. Adams chose to inject himself in this isn't very smart, especially if this turns out to be a crime and not the accident that some are trying to make it out to be. I would not want to associate myself with Monserrate. He might be innocent. But he also might be guilty. It's not worth risking a political career over.

nobody's taking his seat away from him, that's for sure - though i certainly wouldn't mind it if he were to primary borough president marty markowitz.
anyway, i think he makes an important, strictly procedural, point here. sure, it's a ballsy thing to stick your neck out over at this point - but using his insider perspective to critique the NYPD is something i've highly appreciated adams for even before he went into politics, and what he essentially built his career on (and monserrate too, incidentally - whose last campaign i had the now somewhat ignominious distinction of working for in '06. oy. to think i saw him as such a progressive bulldog. the way things are looking i'll just have to keep wringing my hands with shame...)

We all have done it. In fact, it's very hard NOT to critique the NYPD. There have been many reasons (i.e. Sean Bell) why we need to criticize them.

But this case has not been decided yet. Sure, Adams could come out smelling like a rose. But I find a lot wrong with taking Monserrate's side here over, among other things, a "perp walk." Plaxico Burress was given a "perp walk" too, but I didn't hear Adams complaining about that.

What if it comes out (which is likely) that this whole thing wasn't the accident Monserrate, his girlfriend and his girlfriend's family are making it out to be? The evidence shows that this wasn't such an accident. He was caught on camera pulling her hair hours before she was taken to the hospital with cuts to her face. She had cuts on her face caused by glass. This is serious.

This also isn't an appropriate time to start criticizing the NYPD here. They did the right thing by arresting Monserrate. I have read about domestic violence cases where the woman (or man) says it was an accident and it really wasn't. The same could have happened here, which is why the NYPD is taking this case seriously.

If indeed as Adams reports, Monserrate has taken on police abuse and reform and as he further reports this entire event was a huge departure from the normal handling of an incident of this nature then when added to the statements of the purported victim and her own family supporting an accident and not a domestic violence attack, I can only applaud Sen. Adams, a retired police captain, for his courage to stand up and be counted.  If Monserrate is found innocent in all this then Sen. Adams will come out smelling like a rose and the NYPD will have to deal with two police reform Democrats in the State Senate. Since Giuliani, the NYPD has developed a reputation of over reaching their authority into matters that violate peoples constitutional rights.  Happy Holidays!
