NY-20: Tedisco Allies File Suit Challenging Libertarian Candidate In Dutchess County

by: phillip anderson

Tue Mar 17, 2009 at 17:07:13 PM EDT

Here we go. I actually expected something like this sooner, but it looks like it finally happened yesterday. Dutchess County Conservative Party Chair Patricia Killian, with the help of GOP election law guru John Ciampoli (video), have filed suit in Dutchess County to have Libertarian Party canddate Eric Sundwall tossed off the special election ballot in NY-20.

It's pretty obvious that Sundwall is going to hurt Tedisco more than Murphy and now the GOP machine is mobilizing to neutralize that threat. The hearing will be March 25th and I've uploaded the entire complaint (pdf) here.

BEFORE the BOE even ruled on the Specific Objections!

The damn thing is full of uncorrected errors.

It also has the entire standard list of objections, including that they didn't specify the "town/city/county in NYC", whatever that means.

The whole thing is stupid (4.00 / 1)
Without affidavits alleging felonies, I don't think that they can get the petitions thrown out, and with Jim Ostrowski running the show, I'm gonna go ahead and doubt anyone committed a felony. The petition validity should stick.

Their other argument appears to be that they ripped of the Conservative Party logo. This they COULD win on, if they draw a friendly judge, which is probably why they choose Dutchess County as a venue. How that goes on appeal will be very interesting. We very well could end up in a situation where we learn the weekend prior whether He makes the ballot.

Sweeney did this in 2006 too (4.00 / 2)
The Republicans are scared of Eric Sundwall.

The Republicans are scared of letting voters exercise their right of voting for whom they please.

Republicans are simply scared of voters.

It is shameful. I fully support Eric Sundwall's right to appear on the ballot, Tuesday, March 31st!

Sundwall Challenge (0.00 / 0)
This challenge is bogus.

Desperate people sometimes do desperate things.

The ballot have already been printed.  The gate is closed and the election is on.

These folks are just spitting into the wind.
