NY-20: Judge 'Pizza Stain' Brands Now Says Ballots Can Be Challenged Case By Case

Judge Jim Brands, the "pizza stain" judge has just ruled that not only can ballots be challenged on a case by case basis, a move that could delay the seating of a representative for the 20th for quite some time, but that the campaigns can now have access to the applications for absentee ballots so that Tedisco's lawyers can try to argue that the voters that cast those ballots aren't actually residents of NY-20. That's pretty rich when one considers the fact that Tedisco himself is not a resident of NY-20 and couldn't even cast a vote for himself.

This is certainly a break for Tedisco, but I don't know of anyone that thinks that this have any effect on the outcome. That 273 vote lead is just too great a hill to climb.

Jim Tedisco, the GOP nominee in the disputed NY-20 special election, has just won a legal victory for now, with Judge James V. Brands reversing himself on a major ruling from last week, which had appeared to stop Tedisco in his tracks in his efforts to challenge absentee votes for Democrat Scott Murphy. But he still has a lot of work to do in overcoming Murphy's current 273-vote lead.

Brands had ruled last week that Tedisco and the GOP were not entitled to copies of the original absentee-ballot applications. Brands has now agreed with the Tedisco camp's arguments that the legal precedents he cited didn't truly apply here, and that the law does entitle Tedisco to those absentee applications.

Tedisco's camp has challenged a large number of unopened absentee envelopes that are presumably votes for Murphy, saying that these individuals are not genuine residents of the district or are otherwise ineligible. And those applications are key evidence, needed to even begin winning a challenge.

However, Brands also declined to issue a blanket ruling on what constitutes residency for voting purposes -- indeed, there is an acknowledgement that the issuing of a ballot by the local officials itself provides a presumption of regularity. As such, Tedisco will now have the ability to argue against counting ballots, but will have to do so on a case-by-case basis.

So much for the corpse of the once secret ballot and all.

I ca assure you this, however. This will end. The people of the 20th will have a new representative in Congress.

His name will not be Tedisco.

Why isn't Murphy declaring victory? (0.00 / 0)
I understand the principle of counting all the legitimate ballots, but unless there are more than 273 uncounted ballots that Tedisco would like to have counted, it's over.  Why doesn't Murphy just let the counting stop now?

It's better to let Tedisco keep digging himself deeper into the muck.  The longer this gets dragged out, the sillier Tedisco & his supporters look.  He's way beyond the point of taking the high road & conceding so at this point it's almost sadly comical to watch him waste everyone's time & money (taxpayer's that is).  If he runs again in 2010 he'll have that much more baggage.

The longer this gets dragged out, the sillier Tedisco & his supporters look.

And the longer that the people of NY-20 don't have a representative. Tedisco has probably already pissed off about as many people as are able to get pissed off about this. Further delay only serves to deny the voters of their congressman without much more of an upside, it seems to me.

What's amazing is that the Republican party seems to think that drawing this out works to their advantage. One House seat just doesn't seem worth it, since it won't affect legislation that will take place in the interim.

What are the legal grounds that would allow the Murphy team to force this clown of a judge to recuse himself?

Do you feel a sudden chill?  People are going to have the specifics of where they live, how many houses they own, whether or not they flunked out of college in the second semester, etc. made public in a court proceeding just for voting for a congressional candidate?  I mean, I know that some Republicans want fewer people to vote, but, gee, this seems very contrary to our democratic ideals.

And contrary to our statutory rights of (i) a secret ballot; and (ii) having our votes counted by the Board of Elections, not a right-wing zealot.

I really want to know what Team Murphy's next step is.  Can they appeal this?

This is what I was afraid of... (0.00 / 0)
... when I posted some concerns about Brands' prior ruling.

(1) Brands was wrong when he disallowed access to ballot applications. This was one of the head-scratchers in his previous decision, and while the prior ruling helped Murphy, I actually believe Brands was right to reverse himself on this matter.

(2) Much more important and more disturbing is Brands' paragraph about second-home residency and voting. Rather than treating this as a settled matter, with clear precedents going back to 1983, and upheld just last year in Bovina -- which ought to have led him to reject Tedisco's challenges wholesale -- Brands is opening the door to case-by-case arguments on people's residency and eligibility. In his discussion of the matter, Brands only glancingly alludes to past precedents, and would appear to be giving Tedisco's lawyers the green light to put people clearly eligible to vote through the wringer.

As I undestand there are some 12 to 13 hundred ballots challenged. (0.00 / 0)
With individual challenges Tedisco would need to win this population of ballots by some 25% of the vote.  Add to that the fact that most are Tedisco challenges of suspected Murphy voters so overcoming the deficit here is a Nate Silver impossibility.  The larger issues that Robinia and others have noted are the real core of the concern with the ruling.  This is about Republicans wanting to suppress Democratic voters who are second home owners or with other residence. If successful it will also impact hard on places like NY 01 where Tim Bishop has many a NYC supporter with summer homes in East Hampton and South Hampton Townships who choose to vote from those homes.

Judge Stain must go (0.00 / 0)
This is such blatant abuse of office. Judge Stain is a rabidly partisan hack who does not belong on the bench. I'm not a lawyer, but I would think there has to be some recourse. At the very least, a complaint should be filed with the state Commission on Judicial Conduct.

I took until this month to come around on Al Franken and I still think there's work to do in Bush v. Gore.

almost 2000 votes still out there. Yeah, its 99% over. But its not over unless Tedisco or a judge says it is. And that's okay.


Judge Pizza Stain (0.00 / 0)
Up until today when people asked me if this race could turn into to Coleman/Franken I said "no way!"    Now that someone aparently got to this highly partisan judge, I am not so confident.  I wonder if Murphy can appeal this most recent ruling to the Appellate Divison now and get an expedited hearing.   If that's possible, it seems as though this would be the right way to proceed.    Jimmy the Scum Tedisco still lost, but I am shocked that public opinion has not yet forced the Repugs to back down from this ridiculous challange.
