Senate shows up

I didn't expect a quorum to show up in the Senate chamber, but both sides are there. Dean Skelos just called for adjournment, but Malcolm Smith is now calling for adoption of an operating agreement, and wait... no, they adjourned.

In the midst of that, Dean Skelos called on something that John Sampson had suggested - public negotiations toward an operating agreement.

I don't think it likely to happen, but I have to say that's an idea I can get behind, no matter who proposed it.

Update: CapCon has a nice blow-by-blow report if you want more detail. And apparently the Dems aren't taking up the public negotiations offer, instead putting on another sham session at noon. And more, including a photo, from Elizabeth Benjamin.

Later update: Apparently Republican Senator Padavan walked through the chamber while the Democrats were having yet another not-really-a-session. Democrats are now passing a huge list of non-controversial legislation, claiming "Ayes, 32".

If this is really a legal way to pass legislation, there's a lot more wrong with our State Senate than the 31-31 split.

It's Deadline day (4.00 / 1)
hundreds of laws expire at midnight. Important laws that both sides can agree too.

What needs to happen is for there to be two sessions:

Session 1:
31 Dems
1 Republican who draws the short straw
Malcolm presides
Senate passes the renewals of those hundreds of laws.
If they try to pull anything, Republican leaves.
Gavel out

Session 2:
30 Reps/Espada
1 Dem who draws the short straw
Espada presides
Senate passes the EXACT SAME bills.
If they try to pull anything, Democrat leaves.
Gavel out

BOTH sets bills are passed on to the Assembly and Governor, who pass both, allowing things like Niagara County to continue to exist.

Any of it.  I have a feeling we're going to get to see what happens at midnight when everything goes away.

They're counting a guy that walked through the chamber for quorum.  Shouldn't be legal, and they shouldn't be acting like it is.  But if anything, this'll be even more reason for them to avoid any real compromise that would allow a real, legal solution.

It's like they all firmly believe that they can govern via trickery.  It's like they're completely unaware of how this is being received by the voters.

Not that the press is doing much reporting on it, outside of the usual political bloggers and columnists.

In what freakin' fantasy world are the Dems living in that an individual walking in and out of the room creates quorum?  That's so contrary to the spirit of parliamentary procedure that it's ridiculous.  Normally quorum ends literally as soon as you lose it (though often you need a procedural motion for a quorum call to establish this).  You especially need to ensure quorum is present for the purpose of votes.

It's just...ridiculous.  No more of these games where a Senator walking through the chamber signs off on laws.  I'm so  sick of this nonsense.

It reminds me of DAs prosecuting busts of parties with drugs (4.00 / 1)
...anybody who was in the room is implicated, no matter what they were or weren't doing.

Maybe not such a bad way to view some of these crooks....

Quorum call rules in Albany (4.00 / 1)
Another example of how dysfunctional Albany is.

In our state Senate, once you are marked as present, you are considered to continue to be present for the rest of that day's session.  For most bills that come up for a vote, you will be considered to have voted "yes" unless you're there to register a "no" vote.

In this case, Sen. Padavan walked through the back of the chamber some time close to the start of the Democratic session, so the Democrats are claiming that he was present during the quorum call, and therefore voted "yes" on all bills.  Padavan claims that he walked through before the session started (he calls it an "illegal" session), was not present during the quorum call, and therefore did not vote.

Since Gov. Paterson is siding with Sen. Padavan in this case, I'm inclined to do the same.
