Golisano under investigation

by: Dan Jacoby

Fri Jul 17, 2009 at 12:00:43 PM EDT

The Buffalo News reports that three complaints filed against Tom Golisano's PAC, "Responsible New York," have been referred by the state Board of Elections to the Albany County DA.

Apparently, in two campaigns where Golisano's PAC helped they may not have stayed fully independent of the campaigns, as they are required to under law.  The article says that coordinating activities with a campaign is "a felony."

How do you spell just desserts? (4.00 / 2)
Hint: this post.

Allow me to lay this out: (4.00 / 1)
Tom Golisano gave RNY $5,000,000, which is 34x the legal limit for total political contributions in NYS. Felony.

Even if that is legal, Mesi's campaign had Steve Pigeon as a check signer while he wass working for RNY. Felony.

Even if that isn't there, a number of candidates were sharing resources with RNY, and there is incontrovertible evidence of this. Felony.

Even if that didn't take place, they were sharing employees. Felony.

And that's just the public information.

So, Rikers or Attica? Where should they rot?

Yep. (4.00 / 1)
And, if my memory serves me correctly, people on this blog were saying so at the time.

We did... (4.00 / 2)
I outlined one of the original complaints in a post and there have been many posts since discussing this.

Steve Pigeon has a history of doing things that are blatantly illegal. But I think the focus of this should be on Golisano and his hypocrisy about "reform" when the man has practically bought just about everything he's wanted, whether it's a name on a hospital or throwing the state senate into chaos.

The $5,000,000 donation (0.00 / 0)
Since this committee isn't an authorized committee for a candidate, it is apparently not illegal to give $5,000,000.  (Note:  It is not illegal, potential state law notwithstanding, for any candidate to contribute any amount of his or her own money to a campaign committee, provided only that the candidate isn't participating in some campaign finance system such as NYC's matching funds system.  Any state law to the contrary is rendered void by U.S. Supreme Court decisions going back to 1976.)

Pigeon as a check signer?  Not smart.

Allegations of sharing resources (and employees) with two candidates is apparently the subject of one or more of the complaints that have been referred for criminal investigation.  It is clearly a felony.

Bullshit on the non-violation (0.00 / 0)
Just because the Buffalo News said it doesn't mean its true. You wont find a single election law expert in the state with that viewpoint.

The cap is $150K. End of story.

...to prison.

I'm crossing fingers and waiting for those indictments to come.
