Monserrate Found Guilty... Of Misdemeanor

The verdict was handed down today in Senator Hiram Monserrate's assault trial that should allow him some relief.

Monserrate was found guilty of a misdemeanor charge instead of the felony assault charge that would have led to his removal from the New York State Senate.

An outspoken and brash state senator from Queens was found guilty this afternoon on a misdemeanor charge in the face-slashing attack on his girlfriend.

But Sen. Hiram Monserrate escaped the more serious felony assault conviction that would have led to his immediate expulsion from the Senate. That would have created a new round of intrigue in the always-combative Senate because Democrats would have been, for possibly several months, one vote short to adopt bills without the help of reluctant Republicans.

Monserrate was accused by prosecutors of slashing his girlfriend's face with a broken glass last December following a loud argument. The freshman senator, a former New York City police officer, denied any wrongdoing, insisting it was an accident.

This ruling might have been expected, but it wasn't the verdict everyone would have expected months ago. With Monserrate's involvement in the "Gang of Four", many people hoped that he would be found guilty of a felony and booted from office.

It is unfortunate, however, that we do not punish to the fullest extent of the law, men who beat women but we will send a football player to prison for shooting himself.

There is a lot wrong with that picture. A lot.

Where's the broken glass? (0.00 / 0)
As I wrote a week ago, the truth can hinge on the location of the shattered glass.  If it was on the bed, Monserrate is innocent; if, however, the glass is elsewhere, then he's guilty.

But from everything I've read, either the media failed (again) to report the whole story, or the police never bothered to look.  If it's the latter, then heads have to roll.  (Come to think of it, if it's the former then heads should roll as well.)  If the police arrested a sitting City Council member and State Senator-elect on a felony charge, then they failed to investigate the alleged crime properly, it can only mean that somebody on the force is unfit for duty.

For that matter, why hasn't anyone in the media asked this question?  Are they all lazy, stupid or cowed by right-wing nuts?


I also got a negative impression of the job of the prosecutor here (0.00 / 0)
but that might be based on what you said, the job of the media or the police.  If you told me this outcome at the beginning I would have been surprised but as this trial played out, I think this scenario became the most likely outcome.

Don't expect the Dems to try to book Monserrate now...the budget cuts are going to suck up all the oxygen in Albany.

If the Senate Dems have any spine, they'll push a resolution to expel Monserrate from the chamber immediately.  They have the power to do it, and I'd gather that there would be "broad bipartisan support" for it.

The Senator has too many supporters in the Dem conference. The subject won't get any traction at all in their meetings. Carl Kruger, Rev. Diaz and the "Majority Leader" won't even let it be discussed.

SSSSooooo....2010 IS the important time, unfortunately.

Then it's here.  I doubt any of the 30 Republicans would vote against such a resolution.  The bigger question is whether we could get Sampson to allow the bill to come to the floor, which I highly doubt.  Then again, if Libous could get acknowledged to boot Smith and the majority out, why can't we get a resolution to boot a known crook out as well?  Sometimes it just defies logic.
