SD-46: Two To Primary Deadbeat Sen. "Gavel Drop" Breslin

In 2008, when I first came to The Albany Project (and ever since then) my own personal project has been to make sure that State Senator Neil Breslin's term in office as Albany's representative ends with all due haste.  I volunteered incessantly that year for a fantastic man named David Weiss, who was the first person ever to primary Breslin, the only person who ever had the guts to do so.

The video below shows the major role my state Senator, Neil D. Breslin, D-Albany County, played in the June  2009 State Senate coup that he's never, ever been held accountable for.

The video shows Sen. Breslin serving as Temporary President.  He first appears in the top left corner of the video at 0:17.  He's bobbing back and forth and doesn't seem to know what's going on.  Around 0:24, he can be heard stuttering "I...I..."  At 0:32, he appears in the center of the frame, addressing Sen. Libous.  At 0:44, he reaches for the gavel and stammers, "Senna...senna libba...wouldju be quiet!"  At 0:51, Sen. Breslin raps the gavel.  A second later he growls "We adjourn!" At 0:59, he can be seen walking away from the podium.

Let me ask you:  does that look and sound like an experienced, effective State Senator to you?

Now for the real kicker:  the 46th State Senate District is just Albany County, nothing more and nothing less.  Sounds like there's no gerrymandering to speak of, right?

Perhaps not:  His brother, Mike Breslin, is the County Executive, and has been for two years longer than his brother's been sitting in the Senate.  And their other brother?  His name is Tom, and he serves as the County Judge, and was the first of them to enter public "service."

So you see, we have a very big problem here in Albany County that has caused a very big problem for all of New York State.  But still, people here tend to focus their energies on "the other party" or "the turncoats," and the media either ignores Breslin's ineffectiveness entirely or only shows him on television when he's flipping burgers at a picnic.

It's time for that to change.  It was only in the last election cycle that Sen. Breslin faced his first ever primary challenge since first being elected in 1996.  He faced two challengers, one of whom, David Weiss, I volunteered for like crazy, knocking on over 3,000 doors in addition to his 11,000 knuckle-raps.  

But everyone else was caught up in Obamamania, or was digging in their heels in the Democratic Primary to replace Congressman Mike McNulty in NY-21.  I volunteered and blogged about both efforts, yes....but I knew one thing: if all we do is concentrate on Washington, then Albany will remain as dysfunctional as it always has and could very well get worse.

So I hate to say this, but I feel rather vindicated from the video above.  If David Weiss had won, Breslin wouldn't have been Temporary President and perhaps the entire Senate coup wouldn't have happened.

And now I'm glad to report that Senator Breslin will once again have to defend his seat and that the challenges are mounting.  Recently, the Albany Times Union has reported that Breslin will face two challengers in a Democratic Primary this fall.

These will come from Tim Carney and from Luke Martland.  Both make statements available on the web, Marland in the form of a YouTube video and Carney in the form of a written statement:

City of Albany Resident, Businessman, Community Activist and Political Consultant, Tim Carney has filed the necessary papers with the New York State Board of Elections, and has opened his website as he begins his run for the office of State Senator from the 46th District in New York State.

The 48 year old Carney was born in Hudson and is the son of the former Supervisor of the Town of Taghkanic, New York in Columbia County. He has been a resident of Albany County and the city of Albany for over 20 years.

Carney says that he is running "To improve the quality of life of the people of the County of Albany, especially those people that have been negatively affected by the dysfunction of our State Government, which is and has been controlled by Lawyers and by many self serving part-timers, who care more about the special interests of the big lobbying groups that donate hundreds of millions of dollars for votes that go their way."

"I am running as a citizen who will work full-time for the people that elect me. I will never pretend to know all of the answers, but I will find them and I will communicate them back to my constituents, something that our current State Senator has not done. I am running to improve the reputation that our legislators have and to bring some sense to Capitol Hill."
Carney continued, "I began this campaign months ago and have crossed the County attending functions and Town, Village and City Board and Council meetings, asking the people for their ideas and views. The overwhelming majority of the people that I have spoken to have made it clear that the time has come to start putting the People before Politics. Our current State Senator has been in the Legislature for 14 years, he has not been part of any solution, but has been a big part of the problem. He is virtually invisible outside of his office, he is a part-time Legislator and has a reputation of being inaccessible to his constituents. I hope that all Candidates will join me in a frank and open discussion of  the issues that have practically ruined our State, including the ridiculous taxes we levy, economic development and most importantly, the corruption and the lack of ethics in our State Legislature"

Both candidates are gunning squarely for Breslin's easily visible ineptitude:  Tim Carney also features the Senate Coup video featured above the fold on his own website.  

But Luke Martland takes things one step further in a full page rightfully attacking the incumbent:

A Few Words About Neil Breslin:  Did You Know?

Your Senator gets over $100,000 in salary, paid by your taxes, yet the Senate only works 6 months a year?   $100,000 for 6 months work?  A disgrace. I will be a full-time Senator and work year round to fix the problems we face.

Neil Breslin holds a second job at a large law firm, but will not reveal how much he is paid, who his clients are or what they pay him for.  Secret clients and secret pay must end. I will not have a second job - period. I will fight to require that all legislators reveal all sources of outside income and all clients.

Neil Breslin recently voted for an "ethics reform" bill that was reform in name only. That bill would have allowed the legislature to police itself and Senators who are lawyers (like him) to keep their clients from their outside jobs secret.  The legislature police itself?  That's a joke.  I will fight for full transparency and real ethics reform, including independent oversight of the legislature.

Most incumbents believe they are guaranteed re-election.  That is why they ignore what the people want and fight against reform.  I believe we constantly need new energy and ideas in Albany and will propose term limits for all legislators.  I also commit to term-limiting myself out of office.

Our Senators put partisan politics ahead of what matters -- spending more time on the June "coup" and political games than on dealing with the crisis that New Yorkers face. I will be an independent Senator who will work with both Democrats and Republicans and will stand up to the party bosses and leaders.

While New Yorkers struggle through the Great Recession, our legislature has one of the largest staffs in the country (2,700 people) and spends millions of dollars a year on photographers and TV and radio studios.  I will fight to eliminate this kind of ridiculous waste and cut unnecessary spending - starting with the legislature.

The emphasized passages are exactly what David Weiss and I were talking to people about at thousands of doors and on this very site in 2008.  I really wish David would run again...

...but if Breslin is facing a sustained, well-financed and, well publicized challenge this year, then I'm ready to consider supporting either Tim Carney or Luke Martland.  The fact that the press is already paying attention in March of 2010 with the primary way off in September is a good sign.

Last go-round, they didn't print David Weiss's name until four freakin' days before the election.  Let's hope the Times Union keeps up the good work this year.

Man, it was hard to type the words "Times Union" and "good work" in the same sentence.  Just think of what kind of circus the State Senate would have been last year if they had had the gavel in their hands?

Let's not let this happen again.  Let's break the nepotistic stranglehold the Breslins have placed on the throats of Albany County constituents, which played a direct role in cutting the air off for all New Yorkers last year...

...by making 2010 Senator Breslin's last year in office.

There are reasons to believe he's one of the worst in the State Senate.

The only one I'm willing to give a pass is Jose Peralta.  He was just elected days ago to replace The Slasher, so he had nothing to do with it.

As someone who lives in the same town as Breslin, I'm more than happy to do what I can to give him the boot. There was talk around town about his ineptitude seen in the State Senate clip above. I'm tired of having local politics run by the Family Breslin. Any idea which of the two primary challengers we should get behind? My concern is with two challengers it will split the anti-Breslin vote.

I personally like Neil Breslin very much (4.00 / 6)
and having read your post fail to see where there is much of a case against him specifically.

I think primaries are good things so I am glad that Mr. Carney and Mr. Martland are running. I have heard nothing but good about both of them so far.

My personal opinion is that Sen. Neil Breslin is one of the few good Senators in Albany. We can and should always push for the best so if Mr. Martland or Mr. Carney prove to be better candidates then their joining in the primary is an even better thing.

However... let me touch on a few of points raised here.

1. Albany County politics is... um... interesting. The Breslin's lead one block in the county. They happen to lead one of the more progressive blocks that has gone a long way to breaking the power of the old Democratic machine whose remnants are currently lead by Mayor Jerry Jennings. While one can raise concerns about a single family holding as much power as the Breslin's do it does not necessarily entail a problem. If you have substantial examples of their abusing that concentrated power then that is a real issue but three brothers getting elected to offices is not evidence of a problem all by itself.

2. State Senators are officially part-time legislators and are therefore allowed to hold second jobs. This is currently a bone of contention in the state and it is my personal opinion that they should be given raises and named as full-time legislators and barred from holding second jobs. Under the current rules however should Mr. Martland get elected to the Senate then despite his claim to work full-time as a Senator he would be a part-time Senator earning the same $100k for part-time work that he is objecting to Mr. Breslin earning as a part-time Senator. It raises a very real issue about necessary changes to Senate rules but it is being used in a rhetorical manner here that does not accurately reflect the facts.

3. The second jobs of lawyer/legislators in particular with undisclosed client and earnings is also a real issue as shown during the Bruno trial. It is currently perfectly legal and again is not evidence of actual corruption. However, this is an area of rules changes that need be made in both the Senate and Assembly. Legislators should be either full-time and given raises or they should be required to fully disclose client lists and earnings so that full transparency can be had.

4. Staffing of our legislature is a joke. Recent reports (I'll see if I can find the link) show our state's staffing so bloated it outdoes every other state in the nation including California and Texas. This is a real problem. Though, like the other systemic problems that I fully support fixing I fail to see how they can be laid directly at Neil Breslin's feet... which I'll expand on a little below.

5. Lastly, in regard to the coup. Neil Breslin had the unfortunate experience of having been temporary Senate President the day the Republicans, Hiram Monserrate and Pedro Espada pulled that stunt. Can you explain to me exactly what it was that Sen. Breslin was supposed to have done differently? Can you explain to me how the actions of Espada, Monserrate, Skelos and Libous are Breslin's fault when Breslin did what little was available to him to shut down their efforts? Democratic Leadership was caught completely off-guard that day and for that I fault the lot of them for not seeing it coming. But you seem to be singling out Neil as if it was all his fault and I fail to see that connection.

Now... Neil Breslin is one of the few committed reformers in the Senate. It is why I consider him one of the very few that I do not think needs replacing. Prior to Democratic take-over of the Senate he said to me and a group of activists something to the effect that "When we take over the majority it will be tempting to do to the Republicans what they have been doing to us all these years but we can't allow ourselves to do that. It's not right. The rules need fixing and the Senate needs to operate fairly and not just to advantage of the majority."

Neil Breslin was unhappy with Democratic Senate Leadership when they failed to implement more than cosmetic change in the rules after taking the majority. I'll have to search but I believe he is on the record as having said so.

Neil Breslin was appalled by and firmly against the Democratic caucus taking back Monserrate and Espada and giving Espada a leadership role. He is definitely on the record on that.

Neil Breslin subsequently started talking with the very few (less than I have fingers on one hand) other committed reformers in the Senate to form a reform caucus after the coup.

In other words he is one of the few that has actually taken action to do the right thing in the Senate.

If Mr. Martland or Mr. Carney can show me that they will be better than Neil Breslin then I will be open to supporting them but the idea that Neil Breslin is a part of the problem when he is in fact one of the very few that has been working to actually solve the problem is...

... just plain wrong.

Which would be easy enough.  You seem to be making excuses for Mr. Breslin under the guise of "rules changes."

Yes, the rules need to be changed.  But then, why hasn't Breslin lead by example instead of waiting on the rules changes?  Isn't that the ethical thing to do?

But, since I haven't got the time at these library computers, I'll just say this:

If you like Mr. Breslin so much, why is he featured in the What's Wrong With The New York State Senate video posted on your very own Reboot NY website you helped co-found?  He appears at 0:23 as one of the "problems" in the Senate...

...so is he a part of the problem, or isn't he?

I'd like to think that Reboot NY is an organization that demonstrates some consistency in its message.

It's a simple question.  I await your answer.

Andrew took the time to carefully and reasonably offer a detailed critique of your rather flimsy argument but, you can't find a few minutes to do the same? Furthermore, you base your rebuttal on 1 second of screen time in YouTube video? (I know, I should talk right?)

And one more thing. Are you fucking high? Breslin is the "worst of the worst?" Really? Are you really blaming him for not singlehandedly changing the rules of the senate? WTF? That's just ridiculous on its face, pal.

I've been out of work for the past 14 months.  I live in the country and do not have internet access at home.  So it's at public libraries with limited time that I do my work here, which eats into looking for actual work.

I'm glad Andrew is not in the same predicament and I hope you aren't either.

I feel my answer has greater legitimacy.  If Reboot NY is going to urge us to start with our own Senator, but then one of its co-founders is going to condemn me for doing so; and if Reboot NY is going to feature Sen. Breslin as one of the problems and then have one of its co-founders defend him as not really part of the problem...

...that's what I call an inconsistency.

I've already spent a substantial amount of time writing about Sen. Breslin's failings.  It's the reason why I am the ONLY TAP blogger on the SD-46 Tag page here.  Please see my previous posts; their relevancy has only increased in the past year and a half since I wrote them.

And no, I'm not "fucking high."  Having been out of work for so long, I reallyc can't afford to be now, can I. That was a lame answer, Jax.  I hope that's not how you debate everyone; it never gets anybody very far.

BTW...are either of you one of Sen. Breslin's constituents here in Albany County?

I am a resident of Rensselaer County and therefore not a constituent of Sen. Breslin. But as you also know I have been involved in Albany County politics in a variety of ways over the last several years as Albany is the center of the political world for several counties here in the capital district.

Individual Senators do not have a great deal of ability to make change in the New York State Senate. Power is concentrated in the hands of the Senate leadership to a degree that is highly undemocratic, unrepublican, unrepresentative, and thoroughly disgusting.

That said, you raise a very good point about a conflict between this post and things I've said before that are also reflected in RebootNY's message.

I have said "It's a 62 target rich environment" and "Throw them all out!"

I've been called out for that too. There are a handful of Democratic Senators that I believe are worth a darn. Neil Breslin is one of them. Is he a superstar? No. Could we do better? Possibly. Is he part of the problem? No, absolutely not. Is he the worst of the worst? Not even close.

If I was to rank the 62 Senators in the order they need to be replaced Pedro Espada would be #1 followed by a mixture of 30 Republicans and a handful of Democrats. That group would be followed by the rest of the Democrats with a small group of about 5 or 6 Democrats ranked as the very last to go. Neil Breslin would be in that last group of the last to go.

But if it cost me those 5 or 6 decent Democrats in order to replace the other 57 then I'd make that trade in a heartbeat and wish them a nice retirement. Neil included.

So... throw them all out? Yes.

But realistically... some bums are bigger bummers than other bums. :)

at 2:42 this afternoon (after posting my original reply to your post and before your response to it) I sent a note to our Executive Director and the rest of the board informing them that I was recusing myself from the decision making process in regard to SD-46 based solely on having posted this defense of a sitting Senator prior to having met with his challengers.

Mssrs. Martland and Carney are requested to meet with our ED and the rest of the board and not me.

Disappointed in Breslin (4.00 / 1)
I have nothing against Breslin as a person - he's a nice enough man. The problem is that I don't believe that he will change anything or make the tough decisions that have to be made at the moment. I don't buy for a second that he is TRULY in favor of ethics reform. For example, this year he voted for a bill that claimed to be an ethics reform bill, but that really would have allowed the legislature to police itself. Am I missing something here???! Since when is allowing politicians to police THEMSELVES going to work?? This same bill that Breslin supported would have also allowed Senators who are attorneys to continue to have a second job and keep their clients secret, thereby concealing conflicts of interest (needless to say, Breslin is an attorney with a second job at a large law firm, and he doesn't disclose who's hired him for what ...). To me, Breslin has proven to be part of the problem, NOT the solution. What's needed is independent oversight of the legislature.

Given that I care most about ethics reform and oversight, Martland seems like a much better choice than Carney. In fact, I find Carney's platform a bit strange (personally I don't think that raising the driving age is the most pressing issue at the moment...). Martland seems to be willing to fight for real ethics reform, including independent oversight of the legislature. What I find fascinating about Marland is that he's actually putting his money where is mouth is (e.g., won't have any outside work/being full time  Senator, supports term limits and has committed to limiting himself, etc.). I'm curious to hear more about him.
