Why the Gonzalez Indictment matters.

by: NYBri

Wed Dec 13, 2006 at 18:56:06 PM EST

Okay, let's get to the straight reporting, courtsey of James Odato at the Times Union.

ALBANY -- State Sen. Efrain Gonzalez, D-Bronx, was indicted today for allegedly stealing member item money he directed to a nonprofit organization in his district.

Manhattan-based U.S. Attorney for the Southern District Michael Garcia claimed that the member item money -- more than $420,000 over six years -- ended up being used by Gonzalez on homes in the Dominican Republic and other personal expenses. Member items are discretionary funds in the state that lawmakers and the governor send to groups and organizations they feel are deserving.

Gonzalez and three of his ``criminal associates'' engaged in mail fraud, wire fraud, theft of federal funds, conspiracy, and money laundering, the indictment alleges.

This is bad news for all New Yorkers. Let me explain after the flip.

NYBri :: Why the Gonzalez Indictment matters.
True, this is an indictment of Senator Gonzalez and his "parnters," but it's also an indictment of the entire system in Albany.

This act of larceny would, most likely, have gone unoticed if it weren't for the recent public release of details concerning the legislature's pork (member item) appropriations. The pork information was secured only after the Times Union sued Joe Bruno and Shelly Silver for its release. Yes, that's right. A newspaper had to sue the leadership of our own legislature in order to make public details about how our own tax dollars were being stolen spent.

It's true that because of the suit, the appropriations will be made public in the future, but the selection process (what selection process?) and oversite of the appropriations will not substantially be altered. Until each and every appropriation is included as a line item in the budget along with the sponsoring Senator's name attached, the member item system will remain corruptable. If Gonzalez could do it, so could any one else. It's the broken system, stupid.

And it's not just this one area that needs a complete public house cleaning. The Member Item money pot isn't the only secret slush fund in Albany that the legislators have access to...and, because they haven't been made public, it begs the question, "How much more of this corruption is going on that we don't know about?"

No, the job of reform doesn't stop with one indictment. If anything, it shows that our job has just begun.

How many more need to be indicted? How much more dysfunction do we need to uncover? How much more trust in our government in Albany do we need to lose before we wake up and finally kill this rancid "make work incumbency program" that is our state legislature?

It's time we return New York State Government to its rightful owners - the people.

Lipris and NYBri Part of the Problem? (0.00 / 0)
First off...I think that NYBri and Lipris are attempting to "do the right" (or left) thing. Reform is not merely good, but great, while accepting deceit and fraud is bad...period, the end. However, much of their "solutions" and complaints are either a) not realistic, b) based in an alternate universe or c) lacking credibility. Well, you ask...what does ILOVENY mean? Do not fret, ILOVENY shall explain...

NYBri and Lipris do not understand the concept of being bipartisan. Although they take well deserved shots at some democrats (Speaker Silver is an easy target) and republicans (Bruno - again easy target), most of their misguided anger is directed with the wide stroke of a paintbrush at all republicans. Sure, we could all be ignorant sheep and assume that republicans in NY are the same as conservative, religious, pro war Iraq zealots in Kansas, but that is not a productive way to handle the situation. So, you ask, why is ILOVENY making these assertions? Who are the real criminals and fraudsters? Well, "reformers" lets go to the videotape...

Lipris exclaimed and published his biased and unfounded assertion that the fraudster committing the pork related crime of $400K in theft clearly was a republican and likely Marty Golden. I can't profess to know that much about Mr. Golden, but does Lipris base this assertion on the fact that Mr.Golden is a republican or is there some inside information about confirmed and authenticated prior fraud that would point to Mr. Golden committing the pork related crimes? Is it possible that Lipris, blinded by anger and ignorance, is attacking republicans merely because they are republicans?

Again, you ask, what are you getting at ILOVENY? All republicans are not fraudster as I am told? I shouldn't use my common sense and intelligence to view each candidate on his or her own merits? Aren't all the republicans the problem? Well, people of the "Albany Project," lets go back to that videotape to see who the real fraudsters are so that you, the informed viewers (or readers) can make an informed decision...

Fraudster, thugs and criminals in the recent past include Guy Vallela (NYC republican), Efrain Gonzalez (NYC democrat), Alan Hevesi (NYC democrat), Clarence Norman (NYC democrat), Brian McLaughlin (NYC democrat), Roger Green (NYC democrat), ADA Smith (NYC Democrat),Gerald Garson (NYC democrat), Diane Gordon (NYC democrat), and Kevin Parker (NYC democrat). Do we see a theme here?

In other news...if I didn't know any better, I would think that NYBri was the best thing since sliced bread. To start off, he clearly has great ideas and should be commended for his efforts. However, for a candidate that really seeks reform, he should have had the integrity to challenge his opponent, Senator Steve Saland, to a debate. Instead of spewing rhetoric, he should have come up with real reform that would be agreeable to both sides of the political spectrum. Unfortunately, in lieu of challenging Senator Saland to a debate, NYBri posted on DailyKos where his associates, including Tom Ball, referred to Senator Saland as the "Cryptkeeper," "punk ass," and "mini-bush." Talk about credibility!!!! Clearly, there was a complete lack of credibility and that is why Senator Saland not only carried each county, and most, if not all municipalities while NYBri did worse then each and every democrat running for state and federal office in almost every municipality.

I'll finish up here by saying that ILOVENY truly loves NY. If a democrat is going to get the job done...vote for him or her. If it is a republican...vote for him or her. Don't be swayed by the anger of a few. Look at the big picture. Engage others...don't alienate or attack. We can all yell and scream to lower taxes, get rid of pork, and increase funding for education. But please try to articulate how you are going to get this done by working with both sides (remember when mom taught you about playing nice and sharing?).

NYBri and Lipris...ILOVENY...and you should too.

Thanks for the comment, ILOVENY (0.00 / 0)
First, not to into detalis, but Senator Saland and I had several engaging debates and I think we both came out ahead as better candidates.

In terms of reform, it's the system that needs to change and that system presently serves BOTH Democrats and Republicans. The issue of corruption is a bi-partisan issue and The Albany Project is dedicated to fixing a system that allows for such corruption to flourish.

If any legislative body stands in the way of independent, non-partisan redistricting, publishing legislator's schedules on the Internet or including pork appropriations as a line item in the budget along with the sponsoring senator's name, we will work to remove that roadblock. At the moment, most of the common sense reforms of the rules that the Brennan Center has recommended are being blocked by the State Senate.

If we all work to encourage the Senate (Mr. Bruno, who IS the senate for all intents and purposes) to support those reforms, everyone wins, Dems and Reps.

PS. It seemed you posted the same comment twice, so I deleted the first one...

We've got some work ahead of us.

...and in the name of bi-partisanship.... (0.00 / 0)
...let me applaud a statement made by State Assemblyman Thomas Kirwan, R-Newburgh. He was quoted in today's Poughkeepsie Journal:

"I think our reputation as the most dysfunctional legislature in the country, if not the galaxy, remains intact," Kirwan said, adding he would not support a pay raise.

I applaud REPUBLICAN Kirwan for his candor.

We've got some work ahead of us.

But why stop at the galaxy? (0.00 / 0)
Does Assemblyman Kirwan think there might be a more dysfunctional legislature in the universe?

Am I the only one who noticed that the Times-Union - which is only too willing to attack the civil justice system at every possible opportunity - not only USED the civil justice system to acquire this hidden information, but actually touts that proudly?

Personally, I find their editorial content laughable at best, but this is really very interesting.

Holding wrongdoers accountable as the main function of the trial bar?  Enron? Exxon? Merck? Now Albany?

We should *definitely* get rid of all the lawyers though. (note extreme sarcasm)

found this handy chart over at the politicker.

Here's the prop the U.S. Attorney's office used to try to explain how state Senator Efrain Gonzalez allegedly funneled thousands of dollars from member items into his own pocket.
