SD-46: Breslin STILL Refuses Ethical Disclosure Despite Calls from Martland, Cuomo

A full month after Luke Martland called on Senator Neil Breslin to fully disclose his list of clients, citing numerous credible sources, the Senator continues his refusal to confirm that there is no conflict of interest in his being an of counsel attorney at a union-busting and insurance-lobby law firm while the Senator sits as Chairman of the Insurance Committee in the Senate.

Today, Luke Martland adds gubernatorial candidate Andrew Cuomo to his list of sources to bolster his argument:

Andrew Cuomo Called for Full Disclosure in Acceptance Speech

(Albany) - Thirty days have passed since Senate candidate and former prosecutor Luke Martland called on 14-year incumbent Neil Breslin to release his tax records, law firm client list and salary. Martland released his own state and federal tax records to the press on Monday, May 3, 2010.

"It has been a month since I called on Neil Breslin to release his tax records, law firm client list and salary," said Martland. "If Breslin has nothing to hide, why doesn't he simply disclose this information," questioned Martland.

Martland's call for Breslin to release this information has been echoed by the Attorney General, the press, a large bar association and a federal judge.  

Attorney General Andrew Cuomo called for full disclosure of outside sources of income for lawmakers at his nomination acceptance speech last week.

Despite these calls for full disclosure, Breslin has repeatedly refused to divulge his law firm client list and law firm salary.

For the record, Cuomo's statement reads as such, from the transcript of his campaign announcement video:

My Clean Up Albany Plan will enact strict new ethics laws, require full disclosure of all legislators' outside income, and have a real independent monitor, because self-policing is an oxymoron.

I'm assuming Sen. Breslin is supporting the future Governor's election.  But will he actually take action and reveal his client list, or will he prove Cuomo's axiom that "self-policing is an oxymoron" is true?  A recent interview in the Legislative Gazette by Faith Burkins-Gizmet reveals Breslin's arrogance:

Martland recently called on Breslin to release his 2009 tax forms, including income from the law firm where Breslin is of counsel, Hiscock and Barclay.

Breslin maintains he has already done that, providing the documents to the Albany Times Union in January after the newspaper asked all lawmakers to disclose their finances.

Martland also demanded that Breslin release a list of his law firm's clients, citing that the public has a right to know if there is a possible conflict of interest.

Breslin said he finds this argument "absurd." He said none of his clients have any business with the Legislature, and they are guaranteed confidentiality by law. He said it would be an ethical violation if he were to disclose his clients' names.

There's nothing to be read from this except arrogance.  Breslin seems to believe if he keeps on ignoring these calls that they'll simply go away.  How he sees this stubborness helping his campaign is something I simply can't fathom.  If he would only reveal the client list as Martland and Cuomo are saying, his challenger and this blogger would have to find something else to write about, right?

As it stands, without a list of names to confirm there is no conflict of interest, there's no proof there is none.  But there is proof that, as Cuomo said, self-policing is an oxymoron:

Breslin's continued refusal to provide full disclosure.  And that's only one of the reasons Senator Breslin needs to be offerred a retirement package in September's Democratic primary.

Martland and/or Carney are sure losers (0.00 / 0)
in the primary. It won't even be close.

You know that.

So why are you wasting your time and ours on this, instead of working, here and in other ways, to elect Susan Savage or Joanne Yepsen to replace incumbent GOP senators Hugh Farley and Roy McDonald?

A more liberal, in your view, senator representing Albany County would make zero political difference.

Defeating an upstate incumbent GOP senator like Farley or McDonald in 2010 will make a big political difference.

You'll do whatever you want to do, obviously.

But for me, I would not waste any time/money/bloggage on a sure-loser Democratic primary candidate, and instead focus my limited resources of all kinds on defeating GOP senators who suck.

Let it go.  Stop whining about the work other people are putting in to make our broken political system accountable on all sides.

...but I'll still find time to answer your questions.  Sorry if it's a waste.

Regarding predictions of who will win or lose this thing, it's far too early to tell.  Private polling months ago had Breslin at about 40% without a challenger.

Regarding my affinity for this district over others, I'm not actively supporting challengers to Farley or McDonald because I do not live in those districts.  I believe in making my own turf my own responsibilty.  I'm not Farley's boss; I'm not McDonalds's boss.  I live in Neil Breslin's district, and that makes me Neil Breslin's boss, and I believe he needs to be fired.

Also, regarding your thought that only GOP Senators need to go and every Democratic Senator should get to stay because their "one of us," I submit to you the following two names on this, the two year anniversary of a little thing called The Senate Coup.  AHEM:

DEMOCRATIC Senator Pedro Espada, and
DEMOCRATIC Senator Hiram Monserratte

By your logic, we should have continued supporting them because of their party enrollment, regardless of their actions.  Sorry, but I'd prefer my party to be purged of such swine so it can be made progressively stronger against the Republicans.

Regarding more liberal Democrats not making any difference, I have to whole heartedly disagree.  Martland is not only more liberal than Senator Breslin, but more honest, forthcoming, and straightforward.  The subject matter of this diary (which you refuse to acknowledge) also points to him having a stronger personal sense of ethics.

Now, as a retort, I challenge you:  what do you think of all this non-disclosure stuff, the actual topic of the diary?  I've used this topic three times here and all I ever get is the old "Breslin's gonna win, Brelin's the big cheese, Breslin's my home-boy" nonsense without any specific replies to the actual subject matter.  

This confounds me!  Are we not supposed to be the progressives here?  Aren't we supposed to be basing our arguments on reasoned debate?

Because all I see in response is knee-jerk Breslin butt-kissing excuses that would make Oliver North wet himself with glee.

In my book, it's no waste of time holding one's own Senator accountable.  What is a waste of time is kissing the ass of those in power out of some hope to make a good name for yourself.  That may work for some, but I prefer to act like a responsible constituent instead of a cowering subordinate.

In absence of any response, I'm going to have to conclude that you feel attorney-legislators of both parties should be able to keep their clients confidential so they can have all the conflicts of interest they want for all the big money kickbacks they can get, despite the findings of the City Bar Associate, the comments of the judge that put Bruno away, and the comments of the Democratic nominee for Governor.

In that case, why are you wasting your time supporting New York State Senate candidate when you should sending out fundraising letters in support of a Jack Abramoff run for the House?

FWIW, I think Breslin and all lawyer-legislators (0.00 / 0)
should disclose their clients, if such disclosure is legal.

I can also understand why that would be bad for Breslin's business, since clients of non-legislator lawyers would not be made public in the same way.

I also think that this issue is a thin reed on which to base a primary challenge to a longtime Democratic legislator whose voting and constituent service record has been pretty good.

I didn't reply to the specifics in your diary because it was mostly a Martland press release, and because it deals with a minor issue that is much more complicated than Martland and you let on.

Whatever, Albany County Democratic voters will decide in September whether Breslin merits re-election, and few of those decisions will be affected by diaries at TAP, one way or the other.

BTW, I did not say, nor do I "think," that "every Democratic Senator should get to stay because their (sic) 'one of us'".

Martland may well be trying to equate Breslin with Espada and Monserrate, but that is absurd and desperate campaign rhetoric that will not help Martland with most Democratic voters in Albany County.

I appreciate you not responding in kind.  Once again, after re-reading my stuff, I really do think I need to switch to fucking decaf...

I'm passionate about this race because I put a lot of time in on the ground with a challenger two years ago.  I believed then, as I do now, that Breslin's record is anything but good, and my posts from two years ago can explain why, especially when it comes to the banking and insurance industry lobby connections.  This is round two for me, and that's why I get a little over the top sometimes...

We Democrats battle it out between each other like this because, frankly, Republicans just aren't worthy opponents.
