SD-46: Petitions, Financials Filed; Breslin-Martland Race Is On

The Thursday deadline to get your signatures and balance sheets has come and gone if you're a New York State Senate candidate.  In Albany County, three candidates have been at it, asking people for their John Hancocks and Ben Franklins to get them on the ballot and keep them well funded, and we have three very different results.

Defending incumbent Neil Breslin is in the upper echelon's of Senatorial cash hoarders.  The Friends of Senator Breslin is reporting a haul of over $200,000.  This was added to an opening balance in excess of that amount, for a grand total of over $414,000 cash on hand, one of the largest Senate war chests in the State.  

Challengers Tim Carney and Luke Martland both handed in greater than the required amount of signatures to get on the ballot in the September primary.  But only Martland has filed a financial report, since Carney's pull of less than a grand puts him in the "don't bother to file" category.  It also very likely places him in the "non-competitive" category despite his grassroots tenacity.  Luke Martland, on the other hand, has reported over $140,000 in total reciepts and has already outspent Breslin's campaign two to one, leaving him with about $55,000 in the bank.

Speaking of expenditures, I feel these items get a little lost when we all focus on how much people are taking in.  I'm curious about what these candidates are doling out. Reports show that Breslin has been spreading the wealth to local Democratic committees and community associations. I'm not sure if this is common practice, but even if it is it sure looks like good old fashioned political patronage to me, and I find it inronic that Breslin is using all that insurance money to buy, well, more insurance.  

On the other hand, Martland's spending reads like a virtual shopping list from a step by step how to run a local election instruction manual.  These reports show us a candidate building a serious campaign from the ground up, and they prove beyond all doubt that Breslin has a truly serious challenger this year.

The Times Union's Capitol Confidential also lets us know that the Republicans, in Robert Domenici, have just $8,000 under their belt so far, which is, of course, not enough.  But Martland's amount might be enough in such an anti-incumbent year and even against such odds when one considers where Breslin's cash comes from.  Even CapCon and the other mainstream-media run blogs are running that meme now...

From CapCon:

Breslin's haul includes tens of thousands in corporate donations from insurance companies and affiliated political action committees, a fact that you can bet Martland - who has already assailed Breslin of being too cozy with the insurance companies he's supposed to be regulating as chairman of the Senate's Insurance Committee - will try to hammer home over the course of the summer.

...and that's the fact more significant than any dollar figure or signature count.  If Martland's message is able to catch hold, it could very well make up for Breslin's monstrous financial advantage.  Either way, this looks like it will be Breslin's toughest re-election fight of his career, his race to lose, and will remain the biggest political news story of Albany County in 2010.

I decided to take a quick look through that link to all those nasty Democrats that the Senator was "spreading the wealth around" to...

A good portion of those donations were to charities, even when they were to "Party" organizations. I'm a proud member of the Albany County Young Democrats, and I was honored to have Senator Breslin donate to our organization as part of a benefit to VETERANS. So now there is a problem with donating to veterans? And Equinox? And Catholic Charities?

The observations that Upstatesman makes regarding Mr. Martland's campaign finance disclosure are just the tip of the iceberg. I wish I had the time to investigate all of the places that Luke has raised from, including corrupt cronies within the "establishment".

Clearly, you do have the time. Why don't you do a little research on your messiah before you try and take down a dedicated public servant like Neil Breslin?

And it's just my opinion.  I see no need for the troll rating.

Also, like I mention in the diary, I really don't know if this is common practice in every district, for politicians of every office.  Is it?  Because if it is, I'm not sure I really like it.  A campaign donation should just go to a candidate for campaigning purposes, that's what I think.  Really, if every Senator and Assemblyman does this kind of thing, it's brand new knowledge to me, but I still don't like it that much.  Legislators should legislate, not donate.  The fact that the organizations in reciept of the cash are good, charitable organizations makes it a harder point to argue, of course, and that's part of the reason politicians choose them, as well as for the political favor such contributions can buy.  

But it still keeps the big money wheel spinning.  Just my two cents, that's all.

I have no problem with my state senator "spreading the wealth" to help other local Democrats in an election year when he has a surplus of campaign funds.

What I DO have a problem with is someone challenging my state senator in a primary, supposedly from the left, who is "spreading the wealth" to the tune of over $5,000 (so far!) to attorney James Walsh, who is a Republican operative and campaign attorney to Jim Tedisco, among a host of other GOP candidates and organizations statewide.  How does Luke Martland justify that to his campaign contributers?

And I can overlook Spargo's whisperings considering all that Wall Street cash in Breslin's coffers.  Why does such a wonderful, independent minded progressive need so much money directly from the industry regulated by the comitte he chairs?

I never get an answer for that one.  Here's hoping you get an answer for your question.

And having a complete and total disregard for attorney/client privilege? I, for one, would not want my attorney to be disclosing his client lists - it's against the ethical canons of admitted lawyers.

The guy does wills and real estate transactions, he's made it clear the meager amount that he makes from it, and yet (for no obvious reason) you need to know each and every client? It's political jockeying and grandstanding over a very important issue with our part-time legislature and a completely innocuous issue to the public. There are much larger issues to be debated, but Luke Martland (in his infinite wisdom and care for the electorate) has tried to boil it down to the 10-second soundbite regarding some folks who do their real estate transactions through the Senator's private practice.

Instead of having a real discussion about this, we get press releases from candidate Martland demanding disclosure beyond that which is legally required (or appropriate). If he actually had a legitimate law practice, I would be curious if Luke thought it would be OK to violate the confidence of his clients like that.

When an attorney acts on behalf of a client, filing papers, making appearances, etc., isn't there a public record of that?  And if it's public record, why not put all those public records together?

Attorney/client privilege has to do with what the attorney and the client say to each other -- putting facts together, planning strategy and tactics, etc.  It has nothing to do with the fact of an attorney/client relationship.  In fact, in order to claim attorney/client privilege, they have to state publicly that there is such a relationship.

...is right here and it's from May.  You ignored it.  Because you're a Breslin ass kisser, just like every other spineless DINO in this county, more worried about your own skin and what the big wigs will think of you instead of being a true progressive.

A real progressive wouldn't make excuses like that.  Breslin isn't just an attorney...he's an attorney legislator.  The Bar Association down in NYC has held that all attorney legislators should disclose everything, not just take their word for it.  Sure he's just doing wills...we don't need to see any proof, now, do we?

Bullshit.  You do need proof because Breslin is "of counsel," not a parntner, at a firm known for busting up labor unions and cozying with the insurance and banking industry.  Which means it's not necessarily who his client is but who has retained the entire firm with him on as Santa's little helper straight from the Senate Committee on Insurance.  You may call Luke Martland's pointing this out a "10 second soundbite" but really the argument you are making is a two-month-long distraction.

So demanding full ethical disclosure is jockeying for votes and spraying your Wall Street contributions all across the country isn't?  It's a strange old world the Breslin supporter lives in.

My comment basically said that we should know who our elected officials are working for in their "off" time.  It seems to me that this sentiment is in line with what you want -- for Sen. Breslin to release his client list.

I have agreed with you sometimes and disagreed with you at other times.  If you have ever been this stupid in dealing with me before, I have either forgiven or forgotten.  You don't know jack about my relationship with Neil Breslin.

So here it is, in its entirety:  I've never met him, spoken with him, communicated with him or anyone on any of his staffs in any manner.  Recently, I have tried to get some other people who live in his district to lobby him for a bill authored by Sen. Addabbo that would put a two-year moratorium on hydraulic fracturing while the EPA studies the process, and am very disappointed that Breslin seems opposed to it.  I have never said or done anything that smacks of ass-kissing.

In short, you owe me an apology.

You know quite well that the most offensive accusation you could sling is that I am somehow part of the establishment or a "DINO".

One day, when you grow up, you may actually involve yourself in the political process instead of lob insults from the sidelines. Instead of starting meaningless "coffee parties" you might actually participate in the Democratic Party whose Primary you seek to have an impact on. Rather than hurling baseless accusations - you will take time to actually communicate with your elected officials and come to understand that your conspiracy theories really are as childish as everyone thinks they are. One day, when you grow up...

Until that day, I will not be taking any of your insults very seriously. I am about as progressive as they come, save a few issues that I lean slightly to the center on. I have run true progressive insurgents against some of the strongest of incumbents, while you continue to support half-assed challenges from people whom you don't know a real thing about.

The Senator is a good and honest man, who is also NOT part of the establishment here in Albany. Luke Martland's largest support comes from corrupt establishment cronies that have been trying to oust the Breslins from power for years - for no other reason than them ousting their preferred corrupt choices. Perhaps the Breslins are part of their own "machine" (or network of supporters, however you choose to view it) but they are all honest and dedicated public servants.

In all of your tirades you don't possess one shred of evidence to show that the insurance industry in this State is somehow not regulated because Neil Breslin is the chair of the committee - and you clearly don't possess an understanding of the State's role in that process. You don't provide one detail as to why Luke Martland should be elected, other than reposting his talking points, you just sit and trash a great public servant who gives of their life like none other.

So, in short, get a life - and stop using TAP as your personal sounding board for your self-interested "insurgent" candidates. Nobody cares about your self-absorbed rants and self-absorbed candidates. I don't want to hear more about the Phil Stecks of the world, or the Luke Martlands - and I have a feeling that the creators of this blog didn't intend for it to be used in trashing good Democrats. You fail to do your homework and it shows.

Neil Breslin is FAR from the "problem" in the halls of he Capitol, but you wouldn't know that because you refuse to be a part of the process...

Jim Walsh is an election attorney and is on the payroll for that reason.  Tom Slater of TLS Associates is an experienced political consultant who gave Luke campaign advice during the first months of the campaign.  At the beginning of his campaign Luke reached out to numerous Democratic attorneys and consultants, but none would work with Luke because he is challenging a 14-year incumbent from a powerful political family.  

As far as the political affiliation of Mr. Slater and Mr. Walsh, when Luke is State Senator, he will work in a bi-partisan manner with other elected officials regardless of political affiliation to cut State spending, reduce taxes, clean up the dysfunction in the Legislature and create jobs and economic security for working families, seniors and small businesses in Albany County.  

Larry Sombke is the spokesman for the Luke Martland for State Senate campaign.

"Working in a bipartisan manner with other elected officials regardless of political affiliation" is one thing (aside from being redundant), hiring longstanding members of the Republican political machine while claiming to be grassroots and holier-than-thou on contributions and expenditures is another.

At the end of the day Luke Martland is giving away thousands of dollars he received from unwitting Democrats to GOP operatives who will very likely turn around and give that money to Republican candidates and causes statewide.

That is how politics works in Albany County.  It's how County Executive Mike, County Judge Tom, and State Senator Neil all keep their power.  They use fear to stifle any debate or competition.  Coming out against the Breslin's in Albany County, New York is like coming out of the closet in Albany County, Wyoming.  Dig?  It's practically reason number one to get rid of at least one of these guys.

So that's why a GOP connection here or there is fine by me.  A few thousand bucks to a consulting firm is peanuts compared to Breslin's hundreds of thousands from Wall Street.

By the way, did you notice just how quickly Martland's spokesperson came here to answer your question in broad daylight and to the best of his ability?  You'd wait a million years before you got a response like that out of the current Senator.

I have indeed involved myself in the process before.   You know that, you saw me with your own eyes, that's where we first met face to face!  You saw me canvassing for David Weiss in 2008, passed me by in your car, then stopped, reared back and yelled "Hey, Soundpolitic!" to get my attention.  You shook my fucking hand, Dan.  

Now you come here and show your true colors.

I'm too busy looking for work to volunteer right now (thanks for telling me to get a life, by the way, it's soooo easy to have one when your jobless and that's soooo empathetic and progressive of you) but in previous years I've petitioned for the ballot, I've canvassed door-to-door for weeks on end.  

I've phone banked. I've raised a little money. I've produced and put up signs, including hundreds that have disappeared.  I've done this for candidates for County Legislator, State Senator, and United States Congress.

So when you tell me to "grow up" or "get alife" for never doing any of these things when I have done them, you end up looking as foolish as the other commentors here pointed out. It also makes you look very mean and angry and frustrated.  Now why would some lowly blogs touch a nerve like that?

You're also not as progressive as they come, especially when you say that you lean to an imaginary "center." You commented before with your sock puppet 11thWardDem that it's the "looney left wing" of the party that's hurting it.  Care to answer for that?  You also told me before that, instead of fully disclosing your identity, you "prefer to work behind-the-scenes."

Who's campaign are you working on now?

Is it Breslin's?

I wouldn't be surprised.

A true progressive values complete transparency.  That's why when I blogged about NY-21 to get the news out there, I disclosed that was actively volunteering for a candidate.  And that's why I'm blogging about this race.  

I don't disclose any such information in this year's coverage of SD-46 because, frankly, when you've been out of work for a year and half, you spend your time looking for work instead of canvassing, so I'm not a volunteer for Luke Martland. I simply consider him the best candidate, I plan to vote for him, and I say so.

It's that last part that seems to get you so angry and nasty.  I get that you disagree with my opinion, but guess what?  TAP is an open forum where anyone can say such things.  It's people like you that turn threads into flame wars, poisoning our discourse.  

By the way...Why would do that if you didn't think these blogs had some sort of impact?  Do you really think that I think I can swing this election just on my lonesome with a blog?  In your attempt to discredit me, you end giving me...too much credit!

And in the end, you really only discredit yourself.

(By the way, more than one campaign has approached me this year asking me to be the official campaign blogger.  Despite my joblessness, I've declined these offers.  Nobody tells me what to do, think, or write when it comes to my politics because that's what was fought and died for to start this country.  If you don't like that, well..it's a free country...and you're as free as Dan Curtis was to make yourself look a fool, too.)

Still waiting for that substantive criticism of the Senator's stewardship of the Insurance Committee. Or anything to justify how Luke Martland is any more capable than the incumbent Senator. Or really anything that you have against the incumbent other than the fact that he's an incumbent and has taken money from the insurance industry....

That being said: I definitely do NOT work for Senator Breslin's campaign. It would be an honor to do so, but I'm working on other things this summer. (I've spent time unemployed recently as well, pardon me for not coddling you)

One last thing - I give you fairly little credit, but I (and many others around the State) absolutely DO hold TAP in very high regards, and I'm not the only one questioning the integrity of the blog being plagued with baseless and inflammatory posts like yours.

And it's clear that no matter how many times I bring up the facts that Breslin was at the rostrum on the day of the Seante coup, which I see as playing a key role in the Senate's dysfunction...

...or that it's my opinion that it certainly looks fishy when the chairman of a committee meant to regulate a certain industry has raised hundreds of thousands of dollars from that industry....

...or that I believe Breslin is ethical obliged to disclose his client list from his second job at an insurance industry law firm, which the New York City Bar Association agrees with, but he continues to refuse to do so...

...or that I believe that Breslin shouldn't be representing the same constituency in the Senate as his brother Mike is representing as County Executive and his other Tom presides over as County Judge...

...or that I've watched Breslin over the years and seen him flip-flop on everything from education to health care to the environment and hedge and weave at the behest of a party leadership I also disagree with...

...or the fact that I'm just re-stating what's either sent out by any campaign that sends me a press release (I've yet to recieve anything from Breslin) or I restate what's printed or broadcast while injecting my own opinions for the fun and intellectual stimualtion of it, as any lowly blogger can do...

...you will never cease to arrive here and make a mockery of what we bloggers do here and make yourself look stupid, mean, and above all else, a blind partisan hack.

Nothing about my post is inflammatory, except for those partisans who are offended that an anit-Breslin constituency even exists.  All I do in this post is A) link to both candidates financial reports, and B) make note of my opinion based on these factual figures, and C) observe that the mainstream media, which I believe has been biased towards Breslin in the past, has now shifted to echoing the message of his most competitive challenger.

This, to a blind Brelsin supporter, is inflammatory.

Anyone else here see what I mean when I explain what you can expect from the Breslin camp if you so much as hint that you aren't going to vote for a member of the Holy Trinity?  You get insults lobbed at you, you get intimidation, you get...stuff like Dan Curtis doles out.

As for Martland, here are his stances on the issues, and I happen to agree with them.  I've also met and spoken with Luke, and I can say this: he is of sound legal mind with sound legal experience within state government, he is dedicated to marriage equality and the environment, and he has promised to conduct himself under a set of ethical guidelines.  He may not be the most exciting candidate this season, but these position are attractive to a voter who thinks his Senator has been there long enough, and that's all.

You still don't have to agree with me; I don't expect you come here and call that "substantive."

I wish I could say I didn't expect you to come here troll rating a friggin' tip jar, hurling conservative-style insults at my joblessness (I don't want or expect to be "coddled," but it speaks to your persona when you gladly reach for the opportunity to exploit such an angle), and extending a flame war far beyond reasonable limits.

But now, I guess, I can expect no less.

If you want to improve "the integrity of the blog", write some diaries with whatever you consider substance.  Join the community instead of just attacking it with this kind of nonsense.

Though I appreciate the concern, Mr. Curtis outed himself in a similar episode two years ago when he was just as unreasonably upset with my support of Phil Steck against Paul Tonko, his chosen candidate, in the 2008 NY-21 primary.  He just can't seem to deal with a blogger disagreeing with him...and what a pattern of behavior to prove it!

And I admit, back then I lead the charge to out him because he was A) not disclosing that he was a Democratic committeeman, and B) was utilizing a sock puppet named 11thWardDem in addition to his PineHillsResident psuedonymn.  Both of these are violations according DailyKos as well...

I've also gone on the record as personally being against anonymity.  This blog, by Dan Jacoby in April, was an excellent discussion on the subject.  

Personally, I think hiding behind an alias is morally reprhesnsible.  Hiding behind two is worse.  And this isn't DailyKos.  I like Kos, but that site has banned some of the best diarists I've ever read for daring to disagree with the site's overlord.  That doesn't seem very progressive or even democratic to me.

But, if it's the DailyKos FAQ you like to refer to, check out what they have to say about troll-rating, especially as it pertains to tip jars.  Not only did Mr. Curtis troll-rate my tip jar above, but he used my true name as well!  You don't have anything to say about that, but that's fine by me.  I'm not afraid to have it out there, so that's a moot point.

Still, the concern is appreciated, as is your vigilance in ensuring we have a fair conversation here.

I didn't notice that above, but I feel just as dissapointed with what he did. I don't have an opinion on this primary, I tend to keep my focus on WNY and Albany, not the local races elsewhere, so please don't think I singled you out for any reason except using his full name. Clearly there's some lingering issues here that don't involve me so I'm gonna take a step back, but I hope you understand my concerns.

And, no, I don't think you singled me out.  Curtis certainly has; you were just reading through the threads and thought you saw something you thought that needed to be addressed.  Nothing wrong with that.  It's very admirable, in fact, and I very much appreciate it: the blogosphere needs folks like you to bring this sort of thing up once in a while.  This wasn't one of those times, of course, but better safe than sorry.  Please don't feel like you have to hang back because of it; unlike Dan Curtis, I value a diversity of opinion.

I only hope that someday we live in a world where you express your political opinion, put your born name to it, and not have to worry about retaliation...or about mean-spirited partisan hacks like Dan Curtis hijacking your diaries :-)
