Should Eliot resign? No.

As the murky facts of the Spitzer scandal become clearer, the question inevitably arises whether he can or should continue in office.

Leaving aside whatever personal feelings one may have about Spitzer's alleged conduct, it is not at all clear that the governor committed a criminal act; in fact, what is known suggests the opposite. Hiring a prostitute is not a criminal offense in this state or the District of Columbia. Transporting a person across state lines for the purposes of immorality is technically illegal under the Mann Act; however, that Act has not been used for purposes of prosecution since the 1950s.

Nor is anyone alleging that public funds were used in the escapade.

In short, we are not talking, presently, about public crimes, but about private sins.

What Eliot has done is shake the confidence of the public in his image as the ethical sheriff of Wall Street; notably, that part of town is aflame with hilarity at his stumbles. This is, to be sure, a bad thing, and weakens the ability of the governor to lead the state effectively, which places a further burden on a man who has, so far, failed to cow the Albany status quo into acquiescence, 69% electoral mandate be damned.

It's fair to say that Eliot has damaged himself and his administration, probably badly so. An assessment of the actual extent of that damage won't be possible for a while.

So should he resign? No. Barring actual criminal behavior, what Eliot needs to do now is this: recognize that he violated the trust of New Yorkers (and of his family, but that's a different matter), and reach out to the state to regain that trust. Eliot was elected for a reason: this is the worst-governed state in the union, and its people wish for that to change. If he resigns, David Paterson would become the governor, but more importantly, Joe Bruno would be elevated to the position of the lieutenant governor. That latter prospect should send chills down everyone's spine, and not just because Bruno is himself under Federal investigation, but because it effectively removes any leverage for a Progressive agenda in the State Senate. If Eliot resigns, whatever hope we have for a renewal of New York State is diminished.

Bruno's ascension would also give republicans every possible incentive to bump him up one step further on that ladder, by finding a way to remove a governor Paterson. While it's unlikely that they would succeed in that, the mere attempt would paralyze the state government. We saw that scenario before in the impeachment of Bill Clinton, for example. Then, there is the case of Alabama governor Don Siegelman, also brought low by a Federal investigation that turned out to be more politically convenient than founded in fact.

It's fair to say that many New York Democrats are mortified by the Spitzer scandal. Whether it rises to the level of a resignation is sure to be debated hotly over the next few days, but barring further disclosures, probably not.

Sorry Bouldin, I am not the one tossing out the result of an election and (0.00 / 0)
sacrificing our own!  The Governor has accomplished that very nicelyall on his own.  Vitter is there at the utter hypocracy of the LA. State and National Republican Party.  They have to live with their own sense of dignity. My Democratic frame of argument is that when we are betrayed by the actions of our own, we than clean our own house!  David Paterson seems like a good honorable guy. I say we start fresh and let the Republicans live in their own filth if that is the way they want to run their party!

because he has no political capital left, after this.

OTOH, Paterson has plenty of political capital, a less confrontational demeanor, and a realistic chance to do at least some of the "Everything changes on Day One" reforms that Spitzer screwed up, big-time, even before today.

Spitzer can legally hang on to his job, but politically, he is yesterday's papers.

And who wants yesterday's papers, or yesterday's reform politician who today is facing a federal Mann Act indictment.

is perfect- give him the least powerful position in state government while we open up his Senate seat.  

Perhaps the act itself doesn;t warrant resignation, but the political reprecussions of it do- if he doesn't resign, we are handing the rethugs the governor's mansion in 2010.

Eliot Spitzer could have done something far worse, I will tell you that. As evidenced on this very blog today, many people are upset, as they should be. I posted asking "Should Spitzer resign?" to spark debate and discussion. I believe that he shouldn't, but others think that he should.

I asked people to let the smoke clear. I said that because, as humans, we tend to make snap judgments about people in these situations.

Spitzer won't recover totally from this, but he might be able to salvage this term as governor and fulfill at least a few of the promises he made.

It's also amazing that Sen. Sam Brownback, a conservative Republican who pushes a values agenda, suggested that Vitter be censured for his actions. No resignation, just censure.

But, Republicans now are suggesting that Spitzer resign.

IMO it is imperative that Spitzer resign.  

IMO Patterson will be a far better Governor than Spitzer:

1] He actually knows his way around Albany,

2] He can be the anti-Steamroller and get things done via persuasion,

3] We need reform and let's face it after this Spitzer will NEVER be a credible advocate for cleaning up Albany and

4] Last but not least, we need someone to rally the Democratic Party in NY.  Patterson can call on EVERYONE to ensure a victory in the fall elections; whereas Spitzer will simply be a distraction.

Sorry Eliot but you've turned out to be Eliot Mess instead of Eliot Ness.  For the sake of the party and yourself, you need to take a time out and work all of this out.  It would not hurt to study up on the meaning of hubris.  I think you may emerge from this a wiser and a better man.  But it will take some time for you to reflect on what's happened; instead of just trying to avoid what you've done.

The guy was elected as a reformer, a man of the utmost integrity fighting for a higher standard in government.

He has shown himself to be a rank hypocrite in terms of fighting crime (having prosecuted rings of the type he evidently patronized).

In any case, no matter how his offense is parsed (a crime, not a crime, not a serious crime, whatever) he has lost all credibility and all ability to lead the reform movement in our state.

Of course he should resign. Don't be ridiculous.

1) Joe Bruno would not become Lt. Gov. That is factually inaccurate. The State Constitution CLEARLY states that the post would be vacant for three years; there is no provision for filling the post. The President Pro Tem of the senate would take over the duties as president of the senate; that's the longest serving Republican Senator.

2) Spitzer in office = Democrats have to run against Spitzer this fall; We Will Lose Senate Seats We Already Have in that scenario, as well as every last rep incumbent race; our party looks morally void. Mock Debate:
Moderator: "Do you think Governor Spitzer should step down as a result of the scandal"
Democrat: "No"
Republican: "You hate families; have no values; support drivers licences for aliens, love adultery, hate children, kill panda's, and sleep with sheep"

That's what's gonna happen. Spitzer was already killing the party's chances this fall BEFORE today, because of licenses, aliens, gays, wiretapping, etc. Him leaving and giving the Dems a blank slate for the rest of the year is THE BEST thing that could happen.

"In case of vacancy in the office of lieutenant-governor alone, or if the lieutenant-governor shall be impeached, absent from the state or otherwise unable to discharge the duties of office, the temporary president of the senate shall perform all the duties of lieutenant-governor during such vacancy or inability."

I looked through the constitution and couldn't find the provision you're referring to. But I will stand corrected if you show proof.

Also, I don't think we should be calling November a loss already. That's very weak minded. We have several good candidates (I sat down with Dan Ward today by the way) and the Senate races won't change. People were saying that Spitzer would lose the SD-48 race because of the driver's license fiasco and look how that turned out. We won.

So let's act stronger, shall we? We need to start acting like the Republicans do when scandals hit. Instead of being cowards, they stand up and fight back. Not saying I agree with it all the time, but it's a better mentality than just sitting down and taking what's handed to you.

and is specifies that president pro tem would perform the duties; NOT assume the office. It very specifically notes that the office is vacant: "during such vacancy".

Dan Ward can't win as it is, he's a career politician with the additional downside of having always been honest, meaning there is a long history of him saying unpopular things just because they were right. That's honorable, but won't get you elected. Michele Iannello is the candidate who will win the 61st. But she's much better off running against Razenhofer or whoever, and not Razenhofer AND Spitzer.

But performing the duties is pretty much the same thing, only he doesn't get the official title of lieutenant governor. That's still good enough for Bruno, I would think. That is, if he wants to assume such a role.

The Nov. elections are nearly eight months away. If this happened in the fall, okay. I would be worried - slightly. But this is happening long before we have our final slate of candidates for all the Senate seats we want to target. So I think we need to sit back and relax and take things in stride.

One thing I haven't seen anyone address is: what happens if (when) the Democrats take the state senate later this year?  At such point, Malcolm Smith would become the Senate Majority Leader.  Wouldn't he, then, be the Temporary President of the Senate, and thus, perform the duties of the lieutenant-governor throughout the remainder of the present term?  Joe Bruno's tenure with such powers would then only last until the end of this year.

Stephen's logic holds.  It would seem that Spitzer has become a liability to the party, and he'll have a cast-iron b**** of a time regaining any kind of clout.  I hope I'm wrong, but those are my thoughts.
